What does procedural innovation mean for energy arbitration?
As part of the DIS Series Side Event “Arbitration in Energy Disputes: The Users Meet the Practitioners”, organised by Deutsche Institution fur Schiedsgerichtsbarkeit e.V. (DIS) German Arbitration Institute and the Bilateral Italian-German Arbitration Group, our partner Florian Haugeneder moderated a panel discussion in Rome with Eileen Khor (Siemens Energy), Giancarlo Capurro (Statkraft) and Gustav Flecke-Giammarco (Seven Summits Arbitration) on how arbitration can better respond to the needs of the energy sector. The discussion moved beyond the familiar debate on efficiency and explored how tailored procedures, from expert determination to expedited proceedings, can address the specific challenges faced by energy projects.
The conversation highlighted that innovation is not about reinventing arbitration, but about designing processes that fit the disputes they are meant to resolve.
