Third-party funding (TPF) took centre stage at this year’s Vis Moot at the Young ICCA event hosted by KNOETZL.
Following welcoming remarks from Florian Haugeneder (KNOETZL), the session opened with a keynote by Alice Fremuth-Wolf, who took us “inside the black box” of TPF. She challenged two of the most persistent myths: that funders control arbitrations, and that seeking funding indicates a weak case, setting the stage for a thoughtful discussion.
The panel brought together perspectives from across the arbitration ecosystem: Elisabeth Vanas-Metzler (Institution – Vienna International Arbitral Centre of the Austrian Federal Economic Chamber (VIAC)), Malte Stübinger (Funder – Deminor), Jadranka Osrecak (Party representative – State Attorney`s Office of the Republic of Croatia), Natascha Tunkel (Legal Counsel – KNOETZL), moderated by Dragana Nikolic (Queritius) and Arijit Sanyal (Skywards Law). The discussion covered regulatory frameworks, due diligence, confidentiality boundaries, and the scope of influence of the funder on the case.
The panel also explored practical complexities such as adverse costs, recoverability of funding costs, and withdrawal rights of the funder.
